I have found that one of the “commissioners” of the Department of Real Estate expressly requires real estate licenses not to authorize the occupation of real estate by a non-owner without obtaining the express authorization or instruction of the owner and, in addition, advises his client to seek advice on the risks involved. See A.A.C R4-28-1101 (J – K). Not dealt with in this article, but also contemplated under rule R4-28-1101, these are occupation after possession agreements. Rent and security. The buyer must demand the rent and a deposit to be paid at closing and, if possible, as a credit on the purchase price. However, the amount of the deposit and the advance requested should not exceed one and a half months` rent. See A.R.S. § 33-1321. .
